January 1,2011, me and my wife had been out partying with family. My older cousin got to drunk to drive and my brother refused to take me and my wife home. My wife and I got into an argument as a result. The apartment security called the police and I got arrested. My wife begged them not too.I did 6 days because I didn’t have the money to make bail right away. When I went to court I had 5 charges, family violence 2 counts ,battery, simply battery and disorderly conduct. Man was I shocked …then the police report was false. My wife and I were like no big deal she would come to court and tell her side and clear it up.They offered me a deal to take some classes and pay some money to have the charges dropped, but I didn’t take it.So Feb 7,2012 I go to court and tell my public defender(should have had a real lawyer) I want to go to trial so my wife can testify on my behalf. They gave me a new court date.I go ,but I all do it sign I paper proving that I showed up at which point I’m given another court date. Feb 13,I show up my lawyer says hey today is your trial. The first thing I thought was ,wait we haven’t even talked outside the courtroom before today ,how can you defend me?She told me that I could call my wife, but my wife was at home with our newborn alone without a ride and my case was first. The Lawyer explained everything to the judge, but he wouldn’t give me a new court date,so it would be me vs the police who wrote the false report.I have never been in any serious trouble, but I have gotten tickets and I knew the judge would side with the officer,if I didn’t have someone to back my story so I agreed to plead to a lesser charge.24 weeks of classes,2 years probation, the second being non reporting. That’s not justice. They wanted money from me in the beginning and backed me into a corner to get it, that’s not justice. My marriage is fine and we have a beautiful baby boy. I took those lesser charges to keep it that way. Thanks for nothing Dekalb County Judical System.
